The LowerMyBills.com totally illegal mortgage ads

The LMB attorney Heymann claims that the ads were approved by the California Dept. of Real Estate.  If that’s true, there are some seriously corrupt people at the DRE and an investigation of the DRE is in order.

I shall find out.

The ads are posted at the Fight Back Forum

No licensing disclosure and the ads are entirely false and misleading, especially when it comes to the “bad credit OK” statements. Notably, no APR is posted and those advertised payments are nothing but a SHAM.

Robert Braver sued Ameriquest for spamming - LowerMyBills.com ALSO buys leads from spammers

From the Ameriquest cross complaint at http://mortgagespam.com:

9. On or about January 28, 2002, Ameriquest entered into a “Lead Purchase Agreement” with Lead Extreme whereby Lead Extreme agreed to generate and provide consumer leads for Ameriquest (“Lead Extreme Agreement”). Under paragraph 5.3 of the Lead Extreme Agreement, Lead Extreme agreed to comply with any and all applicable federal, state, and local laws in the performance of its obligations under the Lead Extreme Agreement. A true and correct copy of the Lead Extreme Agreement is attached hereto as Exhibit “1” and incorporated herein by reference.

11. On or about March 25, 2003, Ameriquest entered into a “Lead Purchase Agreement” with Visium whereby Visium agreed to generate and provide consumer leads for Ameriquest (“Visium Agreement”). Under paragraph 5.3 of the Visium Agreement, Visium agreed to comply with any and all applicable federal, state, and local laws in the performance of its obligations under the Visium Agreement. A true and correct copy of the Visium Agreement is attached hereto as Exhibit “2” and incorporated herein by reference.

13. On or about August 25, 2003, Ameriquest entered into a “Lead Purchase Agreement” with PEM whereby PEM agreed to generate and provide consumer leads for Ameriquest (“PEM Agreement”). Under the PEM Agreement, PEM agreed to comply with any and all applicable laws and regulations in the performance of its obligations under the PEM Agreement. A true and correct copy of the PEM Agreement is attached hereto as Exhibit “3” and incorporated herein by reference.

Since I can now prove that LowerMyBills.com also buys leads from spammers and the consumers are ONLY hurt by lead generators—ALL mortgage lead generation should be prohibited at the federal level effective immediately with no exceptions.

The damages to consumers are devastating because the companies who hire spammers are nothing but lying scammers.  Many of the victims end up suffering severe financial problems and possibly end up in foreclosure and divorce.

It’s not just about a spam - it’s about peoples’ lives.

LowerMyBills.com finally terminated spammer, requested extension

Last week their attorney Steven Heymann called and I sent him the comment spam from their affiliate and I offered to settle for $1,000.

Today he asked for an extension (no problem) and whether I’d dismiss them because they now finally terminated the spammer, N L Advertising - whoever that is, and of course they just switched the URLs to E-loan.

Why would I dismiss them because they finally terminated the spammer? 

I’ve spent countless hours emailing their president and dealing with dimwitted reps who couldn’t care less about the spam.

I gave them WRITTEN notice of my junk fax suit and all I asked for was the $50 per comment spam.  They chose to protect the spammer:

“… We have contacted the owner of that URL and requested that he refrain from these activities or face the penalty.

Best Regards,
Joe Cascio”

Of course the spammer knew that there is no penalty at LowerMyBills.com and that’s why he promptly posted another comment spam.

Well, I don’t appreciate this crap and since I can’t go anywhere on the web without seeing their ads, I just started taking screenshots of their ads and I’m going to submit the ads to the Cal. DRE for evaluation.

LowerMyBills.com is licensed as a Cal. real estate broker and Mr. Heymann told me that the DRE approves their advertising once a year.  I just find that really hard to believe, especially since I just yesterday spent a few hours reviewing the Cal. B & P and the DRE regs and I posted some of the relevant excerpts.

I just don’t see how the LowerMyBills.com ads could possibly be compliant - with no licensing id, no APR and downright false advertisements such as “bad credit ok” for really low payments.

Why can’t they just advertise the truth?

Requested subpoena policy from LowerMyBills.com

They never wrote back to my request for payment for the comment spam, and it’s rather obvious that lowermybills.com either doesn’t have a no-spam policy or doesn’t enforce it. PROFITS rule.

Ameriquest gets leads from LowerMyBills.com, so this is relevant for that suit too.

The scammers utilize spammers to find their victims.

Also just checked both spammed URLS and they’re still active, it’s rather obvious that lowermybills.com doesn’t mind spamming and unlawful advertising by their affiliates.

My response to Joe Cascio, Lowermybills.com customer care - $100 due

Dear Mr. Cascio:

Did you not read the subject of my e-mail?  Your affiliate and lowermybills.com owed me $50.

I am appalled that lowermybills.com is so obsessed with profits it did not even shut down the spammer.

On 11/14/04, the spammer AGAIN posted an advertisement at my blog, this time to refinance-mortgage-com.com The website is identical to the Home-equity-loan-x.com and it is quite possible that the spammer has many of these sites.

I would like you to do the following:

1) Immediately terminate the affiliate relationship with the spammer and have all lowermybills.com references removed from all of the spammer’s websites.

2) Post a link on your affiliate page at http://www.lowermybills.com/misc/affiliates/index.jsp to my site at http://junkfaxsuit.info/blog.php/fax/C52/ to deter your affiliates from spamming.

3) Pay the $100 now due. 

Lowermybills.com profits from these illegal activities and as evidenced by your e-mail today, failed to terminate its affiliate relationship with the spammer. Therefore, lowermybills.com is responsible for its affiliates’ actions.

It is outrageous that you pay $40 per mortgage LEAD (not closed loan) and the mortgage companies obviously must be paying much more to lowermybills.com. 

It is quite clear why your affiliates spam and why lowermybills.com protects its spamming affiliates.

Please respond by tomorrow, Tuesday 11/16/04, 5 PM.

That’s odd.  Apparently there are porn sites more reputable than lowermybills.com.  They didn’t respond at all to my e-mail to the president.

Home-equity-loan-x.com still has all the lowermybills.com ads.

Years ago I actually was a LowerMyBills.com affiliate, but I soon realized what a scam it is.  I would NEVER EVER look for a mortgage through that site. 

Most likely you’ll end up with LYING and INCOMPETENT scum like Ameriquest.

When I first returned Beatrice’s call at Ameriquest and asked where they got my number, they asked whether I applied through lowermybills.com as they get leads there.

I am SO sick of the comment spam.  My e-mail to lowermybills.com Founder and CEO Matthew R. Coffin is selfexplanatory:

Despite my notice, I received the following comment spam today:
