“Vardan Kushnir, notorious for sending spam to each and every citizen of Russia who appeared to have an e-mail, was found dead in his Moscow apartment on Sunday, Interfax reported Monday. He died after suffering repeated blows to the head.

Kushnir, 35, headed the English learning centers the Center for American English, the New York English Centre and the Centre for Spoken English, all known to have aggressive Internet advertising policies in which millions of e-mails were sent every day.

In the past angry Internet users have targeted the American English centre by publishing the Center’s telephone numbers anywhere on the Web to provoke telephone calls. The Center’s telephone was advertised as a contact number for cheap sex services, or bargain real estate sales.

Another attack involved hundreds of people making phone calls to the American English Center and sending it numerous e-mails back, but Vardan Kushnir remained sure of his right to spam, saying it was what e-mails were for.

Under Russian law, spamming is not considered illegal, although lawmakers are working on legal projects that could protect Russian Internet users like they do in Europe and the U.S.”

And now you know why so many people want to come to Europe and America:  they have NO clue.  Not only are we not protected from spam, but the government and courts protect even the most vile outfits like Ameriquest when they hire spammers engaging in totally illegal spamming.  These lowlife spammers rarely can be identified and even when I served the corporation, they didn’t answer.  I didn’t even bother to get the worthless default judgment.

People in other countries and especially countries with a lower standard of living think that we are “protected” from all the evils and they don’t know that the “first world” civilizations are in a rapid decline.  They have no idea that the corrupt American government and corporations makes the Russian Mafia look like Sunday school. 

They don’t know that the American justice system is based on lies.  The best liar (lawyer) wins.

They don’t know that our legislators sell out the rights of the people to the corporations, so they can maximize their profits.

They don’t know that we have a credit scoring system designed to allow creditors to increase rates for no reason other than a low score.  A system that can lower the scores after deletion of the only derogatory account.  A system that allows lowering the score after the bankruptcy is finally deleted 10 years after the filing.  Yup, the score dropped from 637 to 587.

Maybe something good came out of Vardan’s spam, maybe some Russians actually learned English and find the truth about America on the web.  And hopefully they’ll realize that becoming like the US is NOT a good thing.

Central Pacific Mortgage President, CEO and junk faxer John A. Courson is CalHFA Chairman

Since the junk fax has to do with mortgages, I thought I’d post a summary here.

Actually, it’s not very obvious that the junk fax was for a mortgage, it was disguised as an article with the headline:

Homeowner Warning - “Unbelievable! I’ve lost Thousands of Dollars!”

The post-it fax sticker “From: Mary”, “To: Bob” and “Check this out!” sure adds a nice touch.  So authentic!

They obtained my unlisted phone number when I ordered the report by calling their toll-free number.

Then Michael Williams called me to *trick* me into applying for a mortgage by requesting my personal info for the “report.” Initially he identified his company as Olympic Home Loans, but when he couldn’t find Olympic Home Loans at the BBB, he called me back to let me know that I have to look for Central Pacific Mortgage.

I sent my initial fax to the Folsom Central Pacific office where Williams was and now I’m sending the notice of publication and request for comments for a press release to the executive office for CEO and President John Courson.

It sure looks to me like this outfit operates like Dana Capital and American Residential Funding with countless “branches” and apparently Williams works for their retail division.  I couldn’t find a real estate license for him.

Courson isn’t just another executive moron, apparently he’s a buddy of Arnold Schwarzenegger:

His expertise in illegal marketing?  Lying?  Deception?  Junk faxing?

He will probably claim to “know nothing”—as all junk faxers.  Maybe he’ll blame Kevin Sexton, Executive Vice President, Production

Interesting.  What did he do for GE Capital?  A lot of golfing? 

Being responsible for sales and marketing, it sure sounds like Mr. Sexton ought to know that their junk faxing is illegal

Compliance?  Is that compliance with unfair and deceptive practices laws?

Does he know that their advertising is as unfair and deceptive as it gets?

NCO apparently ignored my request to close the Dana Capital Group credit reporting account

Spoke with Kathy at http://www.ncocreditservices.com/—apparently the Dana Capital access to consumer reports is alive and well!  She didn’t know of any complaints.

I sent her the links with the most relevant postings and the Dana press release.

My correspondence with NCO

It’s obvious that NCO legal doesn’t value consumer privacy rights and since they didn’t take action to protect consumers in response to my complaint, I’ll demand $1,000 from NCO for obtaining my credit report without a permissible purpose.

They can always sue Dana for a reimbursement.  And maybe that will get them to shut off their account.

And I’ll have to write to the CRAs to terminate NCO.  Since they continued to sell credit reports to Dana after they received my notice on 12/27/04, they don’t deserve to be a reseller.

Mortgages and TX AG Abbot SPAM suit

It’s rather obvious that the feds want people to refinance their credit card debts into their houses and generally try to make it as easy as possible for homeowners to get cash out of their homes - so that people buy lots of crap they don’t need and keep the economy going.

I believe that’s the primary reason for Congress legalizing spam and preempting anti spam state laws - I certainly can’t think of any legitimate reason to legalize spam.

On the bright side, check this TX AG news release:

Attorney General Abbott Files First Texas Lawsuit For Violation Of E-mail Spam Laws

This lawsuit focuses on spam not complying with the CAN Spam Act and especially misleading and false advertisements.

“… Ryan Samuel Pitylak, a University of Texas at Austin student, and Mark Stephen Trotter of California, are named in the Attorney General’s federal complaint as controlling PayPerAction L.L.C., Leadplex L.L.C. and Leadplex Inc., three companies registered in Nevada. One watchdog group, SpamHaus.org, ranks the defendants as the fourth largest illegal spam operation in the world. ...”

At MOST, we’ll see a temporary reduction in spam.

There must be thousands of Anthony Ferlantis ready to earn their bounty from scummy companies like Ameriquest and Dana Capital Group.

As long as we have mortgage companies PAYING for the illegally obtained mortgage leads, we will have spam.

This is no different than the drug problem: as long as we have users, we’ll have illegal drugs.

However, while we spend billions of dollars on building prisons and arresting, convicting and incarcerating *drug users*—absolutely NOTHING is done about the criminals who finance the spammers.

In the Austin, TX, Federal Complaint they describe the false and misleading subjects and content:

“In other mortgage related e-mails, Defendants represent that they will take extensive steps to help find the best rate and mortgage available for the recipient. For example, one such email represents that Defendants search “over 300 lenders” and “match you instantly with the lowest rate lender.” (Exhibit 4-5)

28. In truth and in fact, Defendants are not licensed mortgage brokers or mortgage bankers and are therefore legally prohibited from offering or providing any lending packages. ...”

These e-mails sound exactly like the ones I get:
11/24/04 - 173 spams including 30 mortgage spams, Happy Thanksgiving!

You have to be brain dead to not see what’s going on, how the money flows, and why the government (from state banking and real estate departments to Congress) condones all these illegal activities.

Occasionally, someone like Federal Reserve Governor Edward Gramlich forgets what it’s all about:

“… While initially stating that that portion of the subprime industry was veering close to a breakdown, he later called that phrasing too strong. But pointing to the higher delinquency rates in the subprime market and the fact many subprime borrowers are highly leveraged, he said it might be time to look with a little more jaundiced eye at some practices. ...”

It doesn’t take long until he remembers to tone down his concerns.

Edelman sought review of the EB’s decisions, and NCMC and Bridge 21 filed responses.  Edelman contends that EB should not have redacted information as to: (1) the amounts that NCMC and Bridge 21 paid to Fax.com for unlawful junk faxing; and (2) the amount and details of the illegal junk faxing ordered.  Edelman asserts that Exemption 4 should not be used to “reward” a junk faxer for breaking the law by keeping the extent of its illegal activity confidential.  According to Edelman, the law does not protect confidential information produced by the violation of a law, and any evidentiary privilege must give way where it is used in furtherance of illegal activities.  Edelman urges that competitors should have a right to know the extent of NCMC’s and Bridge 21’s illegal activities so that they can adjust their marketing strategies.  He also submits that disclosure will further the private enforcement of the TCPA and that disclosure may serve to deter others from violating the TCPA. ...”
