The court filings: Trans Union, TrueCredit and the secret credit bureau Verifacts
I’m still working on their blogs, it was a chore to prepare all the filings for upload.
To learn more about Verifacts, the SECRET credit bureau (not denied by Verifacts!), read my Response to the Verifacts Motion to Dismiss.
They claim that I failed to state claims for which relief can be granted and that my complaint is based on assumptions. I suppose not being a lawyer, I still have a tough time lying and I THOUGHT that I’d confirm my assumptions through discovery.
Incredibly, they’re NOT denying most of my allegations, but claim that their conduct is legal.
I’m so glad my exhibits are on the public record and I will explain the individual issues at the blogs and in my complaints to regulators.
It took over 6 years to get Capital One to report the credit limits DESPITE my lawsuits, regulatory complaints and extensive publications. And the federal regulators are more corrupt than ever.
I just hope that the word gets out and that many people STOP buying the incomplete TrueCredit credit reports and that a STATE attorney general will go after Verifacts.
MOST important:
The many millions of people who struggle to pay their bills need to realize the extent of the fraud and corruption and that they can and SHOULD vote with their money.
Consult with bankruptcy attorneys, research your state laws, do a little estate planning and STOP paying the big banks if you qualify for Chapter 7 discharge or you are (near) judgment-proof.
THAT is how you create CHANGE in America and it’s the win - win - win situation:
You do what’s RIGHT, you do what you CAN do to protest the corruption and you even benefit financially.

No response from Verifacts—Trans Union FAILS to provide permissible purpose for credit inquiry
Verifacts’ deadline to provide the permissible purpose was last Friday and they IGNORED me. Let’s see if they’ll ignore the summons.
It is AMAZING that Trans Union DELETED the Verifacts inquiry INSTEAD of providing the permissible purpose.
Of course the FCRA PROHIBITS the deletion of inquiries and deleting the inquiry does NOT mean that I’m not entitled to statutory damages of $1,000. And, Trans Union is obligated to restrict or terminate the Verifacts account as they OBVIOUSLY did not have a permissible purpose and they did NOT claim that it was a “mistake”, employee abuse, etc.
My email to Trans Union attorney Tiffany Cox with Strasburger:
Ms. Cox,
I have 3 questions regarding the Verifacts inquiry:
1) Filing another lawsuit is the ONLY way to find out why Verifacts obtained my credit report?
2) Did Trans Union delete my ILLEGALLY obtained personal and financial information at Verifacts?
3) Did Trans Union TERMINATE the Verifacts account to prevent future illegal conduct such as obtaining consumer credit reports without permissible purpose?

With regard to the Verifacts inquiry (#5 below), the inquiry was deleted, which is reflected on the password protected 7/31/09 credit file that we sent to you in an e-mail dated 8/3/09.
I will respond to your other concerns listed below shortly.
So I’ll file the lawsuit and my formal FTC complaint ASAP. It looks to me like Trans Union is covering for Verifacts and I think there’s a LOT more to this than just an isolated illegal credit inquiry.

My $1,000 demand to Verifacts for obtaining my Trans Union credit report
As long-time readers know, I put the permissible purpose claims on the map when Wells Fargo paid me $1,000 for running my credit without permissible purpose way back in 2001. This thread at the now closed CreditForum.org was read over 49,000 times:
Wells Fargo: SETTLED for $1,000 + deletion of UNAUTHORIZED inquiry
I just read it and it’s amazing how patient I was. If Verifacts doesn’t settle this week, I’ll file the lawsuit and it won’t just be for $1,000. I’ve been asking Trans Union for the permissible purpose through their outside counsel Tiffany Cox (formerly Hawkins) with Strasburger since 7/1/09:

Are you telling me that Trans Union does NOT know the permissible purpose for the credit reports it sells?

I received NO response. I also didn’t file the lawsuit because I’ve been so busy and ill. Just for kicks, I thought I’d ask Verifacts what their permissible purpose was. I assume that Trans Union contacted them and they SHOULD have been researching the inquiry for over 2 months.

Please contact me by 9/18/09 to either explain why you obtained my credit report or arrange to pay statutory damages of $1,000.
You must contact me by fax to 571-222-1000 as I receive snail mail only every few weeks and time is of essence.
I will file suit if this matter is not resolved by 9/18/09.

I will update with the alleged permissible purpose, settlement or lawsuit. I just created a new category for Verifacts and unless they settle, there will be a LOT more to post.
