I just today got their motion to dismiss, and as I got ready to write my objection, I noticed Joseph Udall's name on their filing.
UNBELIEVABLE!
Udall should have long been disbarred.

They get away with this crap because most people settle for deletion of the account from the credit report.
BTW, Udall filed his motion to dismiss because I named Capital One Financial Corporation in the complaint (in small letters on the back of the statements) and I served Capital One Bank.
They MUST know that this isn't going to get them off my suit. Is there something I don't know?
