I am SOOO sick of it!
Got another SPAM for a California credit counseling company. I remember getting that crap before, and I'm sure I got notes and a file on it somewhere.
So I called and reached the "Awards Center." Got their address:
5405 Alton Parkway # 5A447
Irvine, CA 92604
He said they're the "answering service" for the faxer, but couldn't tell me what company did the faxing. So I got the supervisor Mr. Michaels.
He told me my number was removed in March and couldn't understand why I was still receiving faxes.
He promised to call me right back. And while I was still typing here, he did call. My fax 571-222-1000 is not in their system, and he said he didn't know which company faxed to me.
He will do more research. I told him that I need to know who to sue.
It's odd that he wouldn't know who the company is, because when I called the number ON the SPAM fax, they obviously know what I'm calling on. They answer with "Debt Consolidation"
He also said that they don't actually do the faxing, but he has access to all the numbers.
If anyone has a link to a similar suit, please post here or e-mail christine@bayhouse.com I could use some help with the appropriate codes.

They were calling me at a number registered on the do-not-call list (of course). Seems like these folks could be nailed under CA and PA laws.

When pressed, the young lady who answered told me her company is called "Award(s?) Center", located in Irvine, CA. I'm not surprised to see others with similar complaints. Now that I've identified the sender of this junk fax, I'm going to file an FCC complaint against this company - for whatever that's worth. I'll also see what actions can be taken within California state law.

Same thing. I got blanket faxed by them, since i have a string of sequential phone numbers. Even my phone number went beep, beep, etc. until I transfered the call to my fax.
These guys definitely know what is going on. They are evasive and refuse to give out any information, including who is sending out the fax. Somone should go after these guys.

I have to work on some filings for *this* suit right now, but am hoping that in early Feb I'll have time to file the Spam suit and I already got the domain for a spamsuit blog.

I received faxes almost every other days. even at 2:00am or 7:00am in the morning. I wonder if anyone beat my record, TOTAL 17 unsolicited faxes within one week.

If you're not already aware, junk faxers are in violation of the Telephone Consumer Protection Act, (the TCPA). The TCPA entitles you to collect a minimum of $500 per violation in your state's small claims court. If you can persuade the court that this is a willful, deliberate violation of the TCPA, you may receive triple damages.
www.junkfax.org is an *excellent* resource to learn about this, as is smallclaim.info. Read up on it, chat with some other TCPA plaintiffs, and you'll find that it's not difficult to wring $1500 or more out of each junk fax client.
Ditto for telemarketers who call you using prerecorded messages, regardless of whether you're on the National Do Not Call List.
I received a $4500 award from one illegal telemarketer late last year, and it was a very, very satisfying experience. =)
Now, with that said, be wary of the "Alton Pkwy" address above. That's actually the call center, part of a nest of scumbags who inhabit Aliso Viejo. (Google "Fax.com" for more info.) You'll get nothing but the runaround from them. Even the name "Awards Center" is bogus.
You're better off pursuing the clients, who hide their slimy tracks far less effectively, and who tend to be easier to collect judgments from.

I have also recieved an unsolictied fax from this company. FYI: never call a phone number given to you via unsolicited advertisements (fax, automated messages, telemarketers, spam). The whole idea is to call randomly (actually sequentally, ex: 212-555-0000 , 212-555-0001 , 212-555-0002 ...etc.) looking for fax machines. The subject matter of the spam is of little or no importance (usually) because what they are really doing is compiling a current mailing list for your area code. Since they pay for your call to their 800 number, they can recieve your caller ID info (this includes your billing info such as name and address) even if you've implemented the caller-id-blocking feature. Your best bet in these situations is to make no direct contact with the company, but instead file complaints with all applicable law enforcement/government agencies, and any other organizations who may be interested. The Better Business Bureau is one that comes to mind. And a good Jewish lawyer, of course.
Of course nothing feels as good as actually tracking down the responsible party or parties and setting them on fire.

I've been getting "fax messages" sent to my cell phone for MONTHS but only recently did I actually forward one to a fax machine to see what it was.
Went to the FCC site.... could select either "Residential" or "Business".... no option for Cell-- any suggestions??

I've recieved more illegal faxes all bearing 1-800-658-8133 as the number to remove ones self from their database. The latest was sent in behalf of Harwell Marketing, has a registration form for a seminar: "monopolize your marketplace", and provides a voice line for registration which is 1 800 246 9201, as well as a FAX #!
Now here's the fun part. Get 3 (or more if needed) pieces of paper and write/draw a nice message on them. Then tape them end to end (making one 33" X 8.5" piece of paper). Now dial the fax number of the offending company/client and feed the paper into your fax machine. When the front comes out the other side of your machine quickly bring the other end of the paper (the part that hasn't gone through yet) over to meet the front and secure it (straight and even) with tape. Now you have an infinite fax transmission in progress as the loop continues to re-feed into your machine and down the wire.
So start the transmission well after business hours (say 10 pm PST) and let it run ALL NIGHT. Make sure your fax machine will redial if disconnected.
If all goes well, you'll feel much better in the morning because you will have done one or more of the following:
1. use up all the ink in their fax machine.
2. use up all the paper in their fax machine.
3. or filled their hard drive with your nonsense
4. tied up at least one of their recieving lines at their expense (800=toll free=they pay for the call).
5. piss someone off and cause them to go postal and kill everyone in their office and burn down the building. but, uhhh, right before that they send you a check for ten thousand dollars. (you wish)
Now, if you'd like to send an anonymous (no caller ID) fax to them, then MAYBE (this used to work, but may not anymore) if you call 0-operator and have the operator place the 800 call for you because your "8" button on your phone doesnt work... or whatever.. then the caller id info they recieve may only reflect that of the operator. Try it.
Also you could post all offending-party-numbers in a usenet message or two... and in some web-guestbooks at really twisted web sites (like Phone Losers of America, a.k.a PLA, a personal fave) etc... this will increase the chance of exposure to a higher percentage of the internet's nut-case loonies.
What I do, which may or may not be legal, is fill out business reply cards with a fictitous business name and one or more of the phone numbers to be harrassed (sp)... and I've been known to place an order or two [( giving false credit card info when ordering merchandise is probably really illegal and not recommended )] in the target company's behalf in an attempt to draw attention from some law enforcement's "watch-list". For instance:
1. 20 copies of "The Complete Guide to Counterfeiting U.S. Currency" from Paladin Press
2. 500 lbs of Ammonium Nitrate
3. a couple of hacked cable converters, or some druggie chemical out of the back of a high times magazine always brings fuzz.
anyway... you get the idea. Besides, it's not likely you'll be recieving any settlement money for these things.
And setting them on fire could get you into trouble.

Hi,
I have been the "target" of junk faxes for a while now and am quite annoyed by them. I think I have a solution to the problem.
We want these companies to stop the illegal fax spamming. We can fight back by using their own business model against them. They faxed you and asked you to call them. So, call them and spend a lot of time sincerely discussing their products and services. Really get into the fine points. I believe that if we are seriously ambivalent about the company's prospective product or service and we still call them to get every last detail about it, we can demonstrate to these companies that it doesn't pay for them to purchase the illegal fax spamming services.
Here's a typical recommend scenario: You get an illegal fax from a company selling health insurance. Call the toll-free number on the fax advertisement and spent 45 minutes to an hour on the phone with a representative. Ask a lot of questions and demonstrate a "sincere" interest in their insurance. The representative should not be able to recognize your true ambivalence about the product or service. This call will waste a lot of their time and they also have to pay for the call. How many times a day do you think they can afford to do this? (Gee, I hope we don't make them mad....)
It takes a lot of people to do this and each one of us must spend some time on the phone to make it work. But, if every illegal fax spam victim is willing to spend some time on this, the illegal fax spamming business will end.
We should all be good consumers and work to get rid of this scourge. Make alot of calls! This solution only works if we can all start doing this. Yes - it takes our time. But, put yourself in the place of the business buying the fax spamming service. They must either increase their staff to handle more calls with no corresponding increase in revenue or they need to terminate their contract with the illegal fax spamming company. What would you do?
These businesses buying the illegal fax spamming services have a multitude of choices when it comes to advertising. No one is forcing them to use these services. Let's show them that it is a very expensive type of advertising.
I realize this is a rather rough outline, but do you know if this has ever been tried before? If so, can you tell me anything about it or point me to some resource?

If you really want to make them pay, call their toll-free "opt-out" number a few times from a PAYPHONE. Calls to toll-free numbers from payphones carry a surcharge of at least $0.25 PER CALL. Of course, it is possible to block payphone originated calls (like 800-555-TELL) does, but these idiots haven't figured that out yet.

Hey, I've noticed that if you call the number to be removed from their fax database (800-658-8133 or -8134) it gives you the option of talking to a "rep" -- presumably about becoming a junk fax customer.
You never actually get a live person. It only gives you a recorded message so that "one of the representatives" can call you back.
I'm thinking of calling them and posing as a potential client, so that I can learn exactly who the company is thats behind these faxes.
I think that if we can find out exactly who owns those numbers (800-858-8133, -8134, etc.) we will be able to stop the problem at the source.

Has anyone found a good chart of remove numbers with postal addresses so that we can send registered letters of private law suits?
I'm all into sticking it to them any way we can, and if we can legally get $500 per junk fax according to federal law, that seems like the most effective way to screw them (not to mention filling our pockets, but that's mostly payment for the hassle of the lawsuit). Junkfax.org and related sites have instructions on how to start private lawsuits.
Even better you can offer them to settle for only a couple hundred dollars per fax and that way not have to deal with actually going to court. These guys can't be earning more than a few cents per junk fax, so if one out of every few thousand people who gets junk faxes sues it'll kill the profit margin.
About half my junk faxes come from 1-800-658-8133.

I got unsolicted fax in wee hours of AM from fax.com. Thanks to your site, was able to track down perpetrator using Google search for junk faxer's phone #. I complained to the California AG. Received a letter back indicating that the AG's office is suing fax.com and WANTS INFO ABOUT FAX.COM AND ANY OTHER JUNK FAXERS so that they can take appropriate action. California AG's press release w/ link to their complaint form is http://www.ag.ca.gov/newsalerts/2003/03-089.htm --AG's snail or fax mail address is Office of the Attorney General, Public Inquiry Unit, POB 944255, Sacramento 94244-2550, fax #916 323-5341. Specifically they want: your name, address, phone # and fax #. Unsolicited fax advertiser's name, address, phone #, date and time fax received, whether you have an existing business relationship w/ the advertiser, whether you have asked the perpetrator to remove you from their fax list, whether you will sign sworn statement re: your complaint if needed. Snail mail or fax copy of junk fax + above info to the AG. The more complaints they get against a particular perpetrator, the easier it becomes for them to take action (and the bigger the fine will be if they prevail).

Out of frustration I typed 800-658-8133 into google and got your forum. I called the number on the front of the fax, 800-670-6024 and talked to someone named Paul,and found that it was the same Award Center in Irvine that you guys have posted about. I looked down some of the links to the law firm at http://www.edcombs.com/CM/Actions/actions146.asp. They have the CFR regulations right there. I called back and talked with Paul again and asked for the phone number of their fax machine. He said that he thought that "they" didn't want their fax number on the front of the fax. Then I read him the CFR requirement, and he immediately told me that their fax number is (714)541-7600. I haven't tried it yet, but was amazed how quickly he told me.

The most effective way to end the problem of unsolicited faxes is to sue the advertiser in small claimes court or to use an attorney in a national class-action suit. You can get $1500 per fax. Nail the bad guys and get a lot of money in the process.
The FCC has sued the fax services before. But, they move on, change their names, or fax from Canada or off-shore where they can't be reached. The law is not effective against them, so instead sue the advertisers and get $1500 per fax.

A follow-up thought for all of us: If every one of us contacts the advertiser (by email via the advertiser's home page on the net) in every fax we receive and advise them to cancel their contract with their fax servicer because of illegal faxing, then the fax servicer could not continue in business. The Alton Parkway address in Irvine is a MBE/UPS Store address, which is typical for spammers.
The Aliso Viejo address, is the same thing (UPS Store).
The good news is that the USPS requires PMB holders to have a valid ID when opening a PMB, so you should be able to subpoena the information to get a correct address to serve the scum.

I received a junk fax for Gold Mining Stock Alert on 10 February which had the toll free number 1-800-658-8133 on the bottom of it. This fax number is a residential line which has been on the national "do not call list" since it started. Lot of good that list is. Anyway, after doing a google search and seeing all of your comments I filed a complaint with the FCC per your recommendations. I also faxed the fax to them. Thanks for the help. Now I know what to do in the future!

I would suggest that in addition to the web sites which have been mentioned, you check http://news.google.com. This maintains current info on over 4500 information sources. It makes it very interesting to track on words such as Fax.com, TCPA, etc. - particularly if you understand how the Google syntax works - e.g., it defaults to 10 items per screen whereas other Google products permit up to 100. The way around it in news.google is to change the querystring to use "&num=100". You may have to alter other strings in the querystring to get it just the way you want it. When you're done, save it either as a bookmark or a shortcut on your desktop - then you can pop it up at will to see what's going on. This also provides a good way to find generic (i.e., "free") versions (e.g., through Yahoo or Wired) of what are normally paid subscription services (e.g., The Wall Street Journal) although they won't show up immediately. Also, things such as the $trillion suit are a bit out of normal - it's to get attention in the mainstream press than anything else. As far as the TCPA goes, you might want to file for more than the $500 or $1500 (treble damages) - notify your Attorney General - think about the Do-Not-Call list - for them to have sent you the fax, their phone had to call your phone. And if your phone is on the DNC list, they're on the hook for something along the lines of $11000-$14000. One state in particular, Kentucky, has something just shy of murder with a dull butter knife to thrash the DNC violators. In addition to the online resources already mentioned, I'd suggest watching newsgroups such as nanae (news.admin.net-abuse.email), easily done via groups.google.com or joining a list such as spam-l. If you choose not to receive the mail from spam-l, follow the instructions to set your subscription to "nomail" and search the archives (you'll have to have a subscription in order to search the list archives). Finally (and last, but not least), taping three pages of paper in a loop for an "endless loop fax" will not accomplish anything except cost them a lot of paper - and paper is relatively cheap. IOW (in other words), you won't pass the interview. Think big, bigger, biggest. Try obtaining a piece of black construction paper and running it through the fax a couple of times. How long do you think it'll take before their toner empties out trying to duplicate the material being sent to it? And I'd try doing it from a Kinko's or other public service - there's no point in leaving a direct lead back to your own fax.

As far as faxing black paper, keep in mind that more and more companies are using internet faxes, as I do. Unless I choose to print, I don't waste any ink. It's definitely not my choice of action either because law suits are a lot more effective and you actully should get paid.

I bought a 5 in 1 printer with fax function and the nightmare began. I kept receiving fax in the early morning or later night. At the very bottom of the fax, it reads "To be removed from out database, call toll free at 1-800-658-8133".
It is REALLY DISTURBING!!!

800-658-8133 is XO Communications, which can be confirmed by calling 503-972-6833. They (XO) told me they handle the Opt-Out list for the client, who is "Data Research", which appears to be the spin off compliance department for Fax.com (per Junkfaxes.org - google for "Junk fax" and "Data Research"). Their number is 888-315-9295.
By the way, to find the responsible party for a toll free number, call 800-337-4194.

Got another one of the "Debt Services" spam faxes today.
The number to call was 800-658-8133 and answered by Debt Services and he told me that's their corporate name and they're in Irvine.
The Google for the number got me right back here, but it used to be MORTGAGE services.
Looking at the corporate filings, I found

I also received an unwanted "Mortgage" fax from the company with the return number of (800)670-6024. As with others, the guy told me he was only an answering center in Irvine for a company called "Mortgage Services". His supervisor told me I could not be given the name of the company who sent the fax with their phone number on it. She hung up on me when I complained. This fax marketing company has been faxing me for weeks if not months or years. They will not stop and I would love to sue their butts off. Anyone know of a class action suit against them? The "remove my number#" on the fax was (800) 658-8133 and I've been on the do not call and do not fax lists for about two years.

The company I work for continues to receive UNWANTED faxes with these telephone numbers: 1-800-658-8133 (to be removed from our database) and 1-800-759-1978 (call us today). Up until now I haven't kept the faxes (for proof in a suit) but they will be kept now. So, when and if there is a suit, I will be happy to add my name. Thank you all for your input and let's keep working to eliminate this CRAP from the telephone lines!

I have lately been having fun--I call the advertisers whose faxes have been sent to me (I have done the 800 658 8133 opt out for months to no avail)and point out that since there is no return fax number on the ad, they are party to a violation of Federal law (FCC requires return fax # to be printed on the top). I have filed an FCC complaint, and am looking forward to small claims court! thanks for all the company names and updates! I'll keep you posted on my results

The way these faxes are being sent is illegal. I should know, because when a customer of mine installs a new fax machine in their business, they have to have an id with a phone number. If they do not, they can be find 500 dollars per infraction. This is the federal law, which hsas been inplace long before the other. The faxes that I recieved come in around midnight (I live in a studio apartment). And to top it off, my fax is set for manual recieve not auto. Also, if I get my hands on the individual, they better be prepared to meet their maker. And I will find them.

I received faxes from CALIFORNIA MORTGAGE INC. with a toll free number 800.816.0435 for a private consultation and 1 800.658.8133 for removal of my fax number from their database in three cosecutive days.The second one was "LEARN QUICKBOOKS TODAY" with the opt out number 1 800.658.8134. These faxes were all received early in the morning. It seems to me like there is only one company sending all these advertisements being hired by different companies. My suggestion is that we should all work together and gather all every piece of evidence for the class action. GOOD LUCK!!!

EVERY time you receive a "junk-fax" be sure to call the toll-free voice number that is printed on it .... then when whoever answers the phone, engage them in an "earnest" ( not really )conversation about their so-called "goods" ( toner cartridges, vacations, investments, whatever ) ....be sure to let the conversation just kinda "drag on" ....basically what you are trying to do is to keep them on the line with you for as long as possible .... thereby costing them money and oh so precious time. If they hang-up on you - just dial them back and start the whole process over again. Works best if you talk v-e-r-y s-l-o-w-l-y and seem as if you are just a bit distracted from the conversation, but just interested enough to make them believe they have a "live-one". And you can probably really annoy them by carrying on your end of the conversation in such a fashion that requires the person on the other end of the line to constantly "repeat" themselves.

I forgot to mention ( in conjunction with my posting above ) ....that you should KEEP ALL received "junk-faxes" ( for possible legal action ) but, also to use them as your very own 'telephone book" to call the printed toll free voice number when you have any "idle time" like ( but not limited to ), while you are, watching tv, doing dishes, going to the bathroom, playing with your children in yard or house, cleaning the house, doing laundry, just pick up your ollection of "junk-faxes" and dial the number(s) and give them your "specially prepared greetings" the opportunities to call and "keep them on the line" are really endless and IF WE ALL DID IT - this nonsense would stop !

I've been fighting this battle now for about 10 months. And all of you are right - It's an epidemic that's out of control.
I have a nice little collection here of all the faxes.
Just know folks, don't fax them back - they pursue legal action (ironic, huh?) for harrasment. Best bet is to do what the others said... just call the 800 numbers and talk to them - very slowly.
But you have to do it now! PICK UP THE PHONE!
Frankly, I'd love to send them an invoice for my time, paper and ink. But we all know that would be a waste of time, paper and stamps.
Oh well.

I started getting junk faxes (different companies, same opt-out number) from those morons at 800-658-8133. I'm glad I Googled the number and found the "Credit Suit" blog. I'm going to file with the AG in Florida. Y'all should take a look at www.faxwars.com. It's from a radio program called
"The Troubleshooter". If you don't know, Tom Martino and his program are nationally syndicated, and he likes destroying companies like the junk faxers. He's got a lot of listeners and has a team of experts that he can call on to help him and consumers when there's a problem that he can't resolve. I suggest you do not give up pursuing the junk FAXES. The government provided you with a private remedy. The FTC and your local attorney general are both interested in helping you. The FTC already spent considerable time dealing with FAX.COM but they also have a large workload. I know what it is like, I used to work for government. In a case I was reading yesterday the judge reviewed the history behind the law, and how much those who wrote and passed the law did to make it consumer friendly for you to pursue tele-marketers and junk faxers. If FAX.COM does go bankrupt, you want to have a claim in before that happens. It seems like they are splitting into smaller companies and you want to start to get in claims against those companies. Read Junkfax.org for more information about how to do it or find someone to do it.
If you donate to one organization this year, I suggest junkfax.org. At their invitation, my law firm listed as one of the attorneys willing to take cases in our state. That made litigation cost effective as we buy the products offered by the junk faxer, or trace phone lines. Otherwise it may have been a losing proposition. Junkfax.org provided all the legal citations and legal information that would have taken dozens of hours to find. It has still taken hours to read the cases and other legal documents they cite, but their research is a time saver. I was able to contact another attorney with a case, and since I was already up to speed on the legal documents filed in his case, he was willing to give me the time.
If you do not pursue your remedies, that is okay. But, it is also helpful to post where you are receiving the junk faxes (what part of the country) so everyone can get an idea where the machines are, as well as the nature of the ad you receive. Also, if you actually order from a business who sent a junk fax, let us know where the product came from. If you ask for an address, you may not get the correct one until you actually order. I would be surprised if FAX.COM is not actually reading these posts, so be discreet.

According to these pages, you have to tell the company to stop and then sue them when they dont. Or file a complaint with the FCC or your State Attorney General. Or both.
So the plan works like this:
1. Get the address
2. Send a letter telling the sender that their fax was against the law and they have been warned.
3. Get another fax spam
4. Sue the spammer, make $1500.
Does anyone have a BETTER address than the 5405 Alton Pkwy, Ste 5A #447? I have a feeling that wont go anywhere.

For those of you who received the toner and inkjet FAX. Would you take a moment to tell me what number you were directed to call to order the toner and also what part of the country (city and state) that the FAX was sent to? You see, it is the same ad, but different toner and inkjet retailers are involved. Furthermore, an "answering service" may distribute orders to one or more toner retailers. All this was intended to make it more difficult to bring a claim under the federal law (and it is) but not impossible. Thank our private investigator for uncovering this fact. But he needs to get the big picture before proceeding any further and would appreciate your help.

I just received my umteenth unsolicited FAX (Healthcare for the Entire Family) with Opt Out number 1-800-658-8132. As usual, no sender FAX number at the top of the page, however, my called ID says it was sent by Stewart Baldwin at 678-945-3661 (Metro Atlanta Area). I called that number and got a recording that the number belonged to his in-home FAX machine and that I would be deleted from his data base. Yeah, sure! I've called this jerk several times and continue getting junk FAXES from him.

Just noticed a junk fax we received on March 22 from "Wall Street Breaking News" (opt out number 800-658-8133) pumping a stock ("rating 10 out of 10") "Premier Development & Investment, Inc." (OTCBB: PDVN). The "current price" was $1.70 and their "target price" $6.25. Guess what: in the last 2 days PDVN has gone from $1.70 down to $0.90 (down 31% today alone). Can you say "Pump and dump?".

I have been battling unsolicited faxes for many years, but I've run into a situation that is even more frustrating.
When I call 866-604-5322 (mentioned in a previous posting from someone else) to have our company's two fax numbers removed from their fax list, the automated system tells me that number has already been removed. HA! Then, why are we still getting their UNSOLICITED faxes?!?
Of course, there's no other contact information on the fax,except for the 866-604-5322 removal fax number. Has anyone had success in contacting the solicitor other than the fax number above?

After considerable effort we did locate one of the companies other than fax.com sending the junk faxes. It took the work of a licensed private investigator. We couldn’t believe it at first. They continued to operate this way having received two prior FCC citations less than two years ago. Although there was the prospect of earning $500.-$1500. per junk FAX, most of those who complained and provided the leads that brought us to the company, did not want to join in a suit. Unless there is a considerable change we expect to be moving out of this area of practice in a short time! You can continue to write to the FCC and your local attorney general; and in fact, that seems to be the option most people choose.

I have received either actual faxes or the annoying sound of a fax wanting to come throuogh on a phone that, because of this problem, is no longer set for faxes for several years. The latest was 3/25/2004. It came in sometime during the night so it may have arrived on the 24th. I can make a pdf of the fax for you but you do not offer a way for me to attach the file. Oh yeah .. the 866-604-5322 folks. Been getting these assorted penny stock pick crap sheets for over a year. I have found out that SPRINT provides the number. Called their security dept. Rude obnoxious female stated they didn't care that one of their subscribers was violating Federal OR state law and if I didn't like it then go change my phone number. "As long as the client pays the bill, Sprint "doesn't care," she added. Well, so much for understanding and some semblance of "corporate ethics" by SPRINT. Filed complaints with FCC this week on it against the "number" and Sprint.

That is what frustrates me so tremendously. I can see why people are afraid to sue pro se, but when you have an attorney who would take these cases - what the hell is wrong with people!!!!!?????
I keep saying that Americans are just a bunch of whiners and complainers, and I know that's not true for all, but I'm very frustrated with how much work I've put in on the credit end, escpecially the ConsumerInfo.com fraudulent charges, and how few people are willing to do something.
And, one of the reasons why I haven't been more active on the fax spam issues is that I've been getting over 50 porn spam comments at the blog every day, and it's getting worse, and I'm just getting VERY sick of this all.
I also heard that a suit was filed against Visa/MC as the companies who enable scammers to scam, and that SHOULD apply to all the porn spammers too. They operate out of Europe or Asia, but they ALL accept Visa/MC.
I'm still hoping to get a separate spam blog soon. If I'm not busy deleting spam comments all day ...

I just called the 1-800-658-8133 over and over again from my fax machine and followed the instructions for removal. Finally, on the 7th or 8th call, a message came on saying that they were no longer accepting calls from my number. Then I did the same thing from my house phone, my office phone and my cell phone. Although I'm sure it didn't make a dent, it felt good to jam up their "Do not call list" 30 or so times...

I have been receiving junk faxes for years now. I must have been one of the first people to sign up to the Do Not Call registry, including the one CA offered and added my FAX number.
I have not called the 800 numbers to be removed, because I thought maybe this is a tactic of them to have us initiate the call first, which then might "establish a consumer initiated business relationship", automatically exempting them from the registry. I may be paranoid...
Anyway, I just dumped the "evidence" in the past, but now that I read all the postings on this, I will save them also, until a class action suit is filed. I get them now to the tune of 3 per day.

After asking to be removed from the database, I was junk fax free for a couple of months. Now it's all starting up again:

Both faxes list a number of 800-658-8133 to be removed from the database.

Check the address (5405 Alton Parkway). It is a UPS Store (independent operator) that also handles mailboxes. I called them at 949-559-5470 and spoke with the manager Mr. Katu Bhatt, who confirmed that they handle mail adderessed to suite 5A. He further stated that I would need to subpoena him to get the name of the party that rents the said mailbox.
I called UPS corporate and they basically said the same thing.
So it seems we need legal action to get anywhere.

I just got the first of two faxes in 2 days from Mortgage Svcs. When I called to request removal on day one, day 2 followed with another fax. The #s are:

I contacted the FCC and they advised me to file via email and mail. I did both. They said it takes a long time for a response. I would love to hear if anyone has received responses from the FCC. It seems that this faxing has started up again recently with a vengence. Strange.
My 2 cents re lawsuits: I am an attorney and the issue I have with legal action is this....if we did subpoena UPS to gett he name of the company AND won a judgement, I would bet my last penny we would never collect. I am hesitant to sue if there is any chance you cannot collect or this a possibility you won't be able to collect. Winning a judgement is not the war; making them pay is the win. That would be the dent needed to stop this crap. I still would LOVE to do a small claims but I need to serve them. I am NOT spending the time/money on a subpoena when UPS might be a dead end.

Some of our members have been fax spammed by fax.com, blocklist.com, et al, but they post them on our web site immediately and Google web search picks it up with a great position in 2-4 weeks. Just go to Google and put in key words "fax.com blocklist.com" and see what pops up! These folks/spammers read our posts/speeches and posting is free for you, so come in and let them see your thoughts, complaints, comments, etc. Only retrieving/reading has a nominal charge because we have no advertising! Advertisers try to control content and that is not what FREE SPEECH is all about!

I am outraged at this blatent attempt to get peoples' data so that they can be MARKETED.
Additionally, you mention a fee. Why the hell would I want to pay a FEE to read peoples' rants???? The web has more free rants than anyone could ever read.
It is very unfortunate that due to huge amounts of comment spam at this blog, I WILL have to require registration with a valid e-mail for POSTINGS - as soon as I get to it.
And I also CHARGE for information at my CreditFactors.com forum. But that's information, NOT rants. I'm even considering a separate similar subscriber only forum AFTER I compiled useful info on how to sue for fax spam, and I'll post my own filings as well as the court filings I pay to have the courts copy and mail to me for scanning and uploading.
But even for my paid services and subscriptions I NEVER require more than the name. I go through PayPal because I don't want the liability of having peoples' data. Just last week I became a victim of ID theft!
Even I have to eat, and pay the bills. But it would never occur to me to charge a fee for rants. And there will never be a registration required to READ my blogs.

Some of you may have received a FAX concerning a settlement in the Direct TV and Prime TV case. I could not believe it when I did, so I checked to make sure it was for real. A pest control company sued for illegal FAXES, and their attorney turned it into a class action suit. In some states you can do that for these claims, in others you may not. According to the settlement, everyone who got the junk FAX receives a transferable coupon good for six months of free Direct TV service. I recall receiving something like that in an earlier class action suit, and I was able to sell it on EBay. It is not the $500. - $1500. I would hope to receive, but it is something. So, there is a law that is being enforced by the courts after all. Maybe not as quickly as we would like, but it is happening.

The "Health Care for the entire family" info is from a company in Belaire, Texas, called by many names, but the most frequent one is "Family Health". The guy running it is a lawyer named Chris (or Kris) Rabie, at a law office at 6750 West Loop South, # 870, Bellaire, TX 77401. His phone is (713) 218-8500. His Dad, Mike Rabie, runs a similar operation at 10333 Harwin Drive (several different suites) in Houston, which is nearby. He calls his outfits by about a dozen different names, but the most frequent is National Assn of Prefered Providers.

Thanks Tom, we had a fix on the company in Houston, but the mail to Harwin Drive was coming back "not deliverable as adressed and unable to forward." Our investigation company was not able to track the "800 number" but you sure did. What you said about the FAX broadcaster coincides with our guess. Since Delaware is a half hour from our office and the marketing business broadcasting the FAXES is registered there, that makes it much more likely to get a judgment that has to be honored (they must have a registered agent there) as well as bring it to the attention of the authorities there and search corporate records. The name O.W. Long came up as a registered agent for one of the companies. Does that name ring a bell?

I called a lawyer in Irvine who is working on a fax.com suit in CA. He says that the respondent got the cases against them consolidated in the Los Angeles Superior court. This is good and bad because it funnels all cases together, but it usually results in delays, which is what the spammers want.

Hi- I get the same bloody faxes from them and I will not waste my time finding out who, what, where etc
Instead I plug in my telezapper. I had it on my home line then realize that I could use it for my fax line. It works. Here's what it says:

I am so sick of these crap faxs. I am a widow living on a fixed income. I have to have my fax machine on all the time for a side business I have. These stupid faxes are eating up my ink which we all know is not cheap, not to mention the paper. Please let me know if there is anything I can do to help get a lawsuit started. The telezapper doesn't work for computers. I don't even understand why anyone would still use a "fax machine" for receiving faxes. I found that manylaw offices also utilize computer reception. I'd go insane with all that paper.
I finally started to read up on AZ law today, $5 per fax, I think I'll stick with the federal law and just throw in AZ unfair and deceptive practices for false advertising on some.

Around 03/23/2004 I received an unsolicited fax from PowerHouse Stock Picks promoting investment in BodyScan Technologies (BDYS). See www.bodyscanimaging.com. Based on WWW information, the head of BDYS, a Mr. Anthony Sciuto, may have prior securities offering problems. See: http://www.wdfi.org/newsroom/admin_orders/99_archive.htm.
The only contact information in the fax regarding PowerHouse is a number to call (1-866-604-5322) to be removed from their fax list. I believe I have previously requested removal from this list.
On 05/19/2004 I received an unsolicited fax from Big Profits Stock Picks pumping Twister Networks, Inc. Again, the removal number is 1-866-604-5322. Interestingly, Twister is located at 19200 Von Karmann Avenue, Suite 600, Irvine, CA.

These are my latest unsolicited faxes: OTC BB Reporter, no way to contact them. The call to report error number is 1-866-305-9836. It does no good to call it. I think this is a company located in Australia and they are advertising stocks of different companies. one listed is Compaq Canada and the other is IPFS shares. I will pursue some of the ideas found on this site.

Australia??? I get those spams too, and I intended to name the advertised companies. Of course that's difficult if they're outside the US, but I've already read up on international serving and since they're publicly traded, they probably wouldn't want me to send out the announcement of my suit in a press release. Love those press releases ... so much bang for the buck.

Thanks! I'm closing comments for this blog because I'm moving it to new software and hopefully I'll actually be able to file my suit.
A little off topic, I just filed a new credit suit and one of my claims is that Ameriquest Mortgage or their agents are spamming me with deceptive and false advertisements.
I get about 20 spams a day misrepresenting that I had communications with them and that I'm "approved."
All I know is that the source for their call was "internet" I expect to find out in discovery what exactly they are doing.
