Re: Phoenix District Court 03-CV-525
Dear Mr. Munn:
1) When I called you on 5/19/2003 to inquire whether you would accept the waiver of service, you advised that you would prefer to be served. I would like to confirm that this is correct and that I need to incur the associated expenses. Why does Nelnet refuse to accept the waiver of service?
2) When I first spoke with you on 4/7, you assured me that you were submitting the account to all three bureaus as paid as agreed. I requested that you fax me a copy of your bureau update and you agreed to do so.
You also asked me to dismiss Nelnet as you were now reporting accurately and I declined as I incurred substantial damages. You disagreed, and you stated that a creditor reviewing my report would have concluded that my incorrectly reported as "included in bankruptcy" student loan was not discharged as student loans can not be discharged.
Your totally false and absurd statements are exactly WHY I am publishing my suit.
I also did NOT receive your bureau update. The account is still NOT reported to Equifax. Experian promptly reported 8 late payments.
Am I assuming correctly that this was a consequence of my decline to dismiss?
3) On 4/7, I mentioned that I don't understand why Nelnet refuses consumer credit reporting disputes and instead demands that consumers dispute with the credit bureaus. You confirmed that this is Nelnet's policy. Why is that so?
4) On 4/7, you also told me that my account had been reported as "included in bankruptcy" due to a "glitch." I got the impression that you didn't care what that glitch was or is, and that you had not done an investigation to determine what EXACTLY happened. You did NOT mention any improvements to your credit reporting system or efforts to correct the reporting for other borrowers who may also have been damaged and continue to be damaged due to this "glitch."
Am I concluding correctly that you couldn't care less about Nelnet's incorrect credit reporting and the subsequent damages Nelnet inflicts on other consumers?
As this is a published suit and I want to ensure that my publications are accurate, I'll appreciate your written response via fax to 571-222-1000.
Very truly yours,
Christine Baker

I am a loan originator, not only has Nelnet reported innacurrate information on me (thus destroying my once perfect credit) I see hundreds of credit bureaus with Nelnets innaccurate info on it. Of course I make it a point to check this out since it has affected me personally. I have faxed, written and phoned in order to get my info corrected and they will not do so! Once the credit bureaus themselves changed the info to correct it only to have them re-report it innacurately the next month and put it right back on my credit. I would like to be part of a class action against them, if anyone is thinking of putting one together I'm sure I could get some of my customers involved as well.

Jill, I haven't actively worked on Nelnet due to all the Experian/ConsumerInfo.com activity, but I'm printing those exhibits for mailing to Nelnet as I type.
It's time to get moving. I registered http://nelnet-complaints.us/ and hope to soon get a summary page up with common complaints.
I'm not a big fan of class actions because the $$$$ go to the attorneys - the consumers get next to nothing (literally). There are some exceptions, and class actions are great for very MINOR offenses, the kind of stuff where you can't show damages to an invidual.
Anyway, if you'd like to contribute to that page, you can e-mail me at christine@bayhouse.com and we'll talk details.

Nelnet is currently reporting on my credit bureau as incorrect and I have had then correct and then the next month they turn around and resubmit the incorrect information and I am tired of calling them every month..I am trying to get a house, and they are destroying me.

There's nothing like a law suit to get their attention!

I just ordered my credit report from Equifax and noticed that HellNet...I mean NelNet was listing four months of serious delinquent activity from 90 days to 120 days on Equifax and TransUnion but not Experian. I did have a student loan with them way back in 1991 and it was paid in full in 1993. I called them this morning and they told me that my loan was paid off in 1997?? Since it was actually paid off in 1993, I have not recieved any correspence from NELNET since then and I most assuredly did not make a payment to them in 1997. All of the negative late payment information on my credit report shows up in 1997 as well....Hmmm..it's almost as if they screwed something up in 1997 and there method of fixing the problem was to just mark the paid in full date as 1997 and not bother with fixing the delinquent activity. If you ever have success at getting their attention I would love to hear about it.
Thanks,

They list mine every month 4 separate entries as "included in BK" even though it's been repeatedly called to their attention. I'd like to sue their A$$'s.

First you need to dispute the reporting with the CRAs. They did not violate the FCRA until they verified it with the CRAs.
Have you done that?

i have two student loans threw nelnet. the first they call group A and the other is group B. on the group A loan i had two seperate loans and at the time they were known as UNIPAC. One loan payment is for $111.00 and the other was for $50.00. I used to get billed seperately for them, then NELNET took over and combined them and made one payment of $161.00 amouth. Nelnet did this with out even asking me. Hell Nelnet even combined both groups together to make one big bill. The other being $147.00.
I called and complained to them about what they did without my knowledge. After a few mouths and alot more calls from me they fixed the payments back to the two groups. the only thing they did not do was seperate the group A loans.
In Feb. 2002 i sent in a payment to pay off the smaller of the two loans on my group A. On my stub there is an area where it says special instructions and to write in that area to have me notify them of change of address or special payment instructions. I did just that, told them I wanted to pay off smaller loan and drop my payment on my group A loan back to $111.00. I signed and dated the stub where it shows to do it. It was almost $500.00, they took that money and spread it out threw all of my loans without reading the instruction I wrote.
It took me several mouths and alot of calls to get it fixed, and it wasn't Nelnet that fixed it. I had to call to where the loans originated (RISLA). It took the woman I was talking with a while to find where Nelnet put all that payment.
During all the crap that been going on, Nelnet has yet to drop my group A loan payment back to $111.00. I'm still getting billed for $161.00. I would just send the $111.
In Nov. 2002 I recieved a letter from Nelnet congratulating me on paying off one of my loans(paid off in Feb.2002). Since that time they have been adding the $50.00 payment that no longer exists, and taking money from one payment to put with another. Now Nelnet is telling me that I am three mouths behind on all my loans and has put me in collection. I have talked to that agency and they understand. I have also had the Denver, Co. BBB involved, to which Nelnet has done nothing to correct their mistakes. As of now I'm waiting to here from my lawyer as to what I can do. I have kept every reciept of payments made and also had Nelnet send me a copy of my payment history with them, and you can see where they are making mistakes
