On April 25, 2003 I sent the Waiver of Service and the filed complaint to Mary Mello, the Agent for Service as per the California corporate records.
I received no response.
On 7/2/03, I called the 800-300-5099 on my final phone bill:
After about 20 minutes in VM hell and on hold, a rep gave me the 800-791-6661:
"Your call cannot be completed as dialed ...."
I should have known better, that's exactly what I went through when I kept calling them about the check they deposited and failed to credit in 96/97.
Extreme frustration ...
So I looked up Pacific Bell at Yahoo and called their 415-394-3000 to their 140 Montgomery office in San Francisco:
Long hold, then spoke with Mr. Iljas, Executive Offices:
I explained that I had filed a federal suit in Phoenix and that I wanted to confirm their receipt of the Waiver, mailed to Mary Mello in San Jose.
Mr. Iljas advised that he could not speak with me due to the pending litigation, but he promised that he would have an attorney get back to me and he refused to give me permission to record the call.
Another half hour wasted.
7/7/03: Called Executive Offices again, asked for Mr. Iljas but got to speak to Mr. June:
He gave me the 800-291-4952 and told me I had to go through that number for legal process.
Then he looked up my phone number and there was a LONG silence while he read the notes on the account.
He advised that according to the notes Pacific Bell would not respond to my complaint because I had not filed the court papers properly - according to their legal counsel.
Mr. June refused to provide any fax # or a phone # for their attorneys.
He again stated that I had to go through the "legal process" 800 #.
Called 800-291-4952:
It's a # for subpoenas and apparently they were already closed at about 3:40 PM.
I left a LONG message on their VM, advising that this is a published suit and that I was RECORDING this message to be used as evidence in court. I stated that I want to speak to someone in the legal department to confirm the receipt of the Waiver of Service, I stated my case and phone # twice.
When scum like Pacific Bell refuses to communicate, RECORDING these voice messages is the best way to document their contempt.
If they don't call me, I'm going to leave several more RECORDED voice messages on various VMs.
This is EXACTLY what I went through in 96/97 when I spent so many hours on the phone with them, on hold, transferred around ...
Next week I'll pay for serving them if they don't contact me or refuse the Waiver. Thing is, I'm not even sure that they received the Waiver, they could be talking about last year's small claims suit.
